Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website located at thescholarpath.org (the "Site"), operated by ScholarPath, Inc. ("ScholarPath," "we," "us," or "our"), a California nonprofit corporation. Please read these Terms carefully. By accessing or using the Site, you agree to be bound by them. If you do not agree, do not use the Site.

1. Use of the Site

You may use the Site for lawful, personal, non-commercial purposes consistent with these Terms. You agree not to:

  • Use the Site in any manner that violates any applicable federal, state, local, or international law or regulation
  • Submit false, misleading, or fraudulent information in any scholarship application or contact form
  • Attempt to gain unauthorized access to any part of the Site or its related systems
  • Use automated tools (bots, scrapers, crawlers) to extract data from the Site without our written permission
  • Impersonate ScholarPath, any ScholarPath staff member, or any other person or entity
  • Transmit any material that is unlawful, harmful, harassing, defamatory, obscene, or otherwise objectionable

We reserve the right to suspend or permanently block access to the Site for any user who violates these Terms.

2. Scholarship Applications — No Guarantee of Award

Submitting a scholarship application does not guarantee that you will receive an award. ScholarPath makes all award decisions at its sole and absolute discretion based on available funds, applicant eligibility, and the criteria established by each scholarship fund.

By submitting an application, you represent and warrant that all information provided is truthful, accurate, and complete. Submitting false or misleading information is grounds for immediate disqualification and may result in recovery of any funds already disbursed.

ScholarPath is under no obligation to review any application, notify applicants of decisions within any particular timeframe, or provide reasons for its decisions. Award amounts, fund availability, and eligibility criteria are subject to change at any time without notice.

Scholarship funds, if awarded, are disbursed directly to the recipient's accredited educational institution and may only be applied to tuition, fees, books, or other approved educational expenses as defined by the applicable fund.

3. Affiliate Links and Sponsored Content

The Site contains affiliate links to third-party products and services, including but not limited to Grammarly, Chegg, Kaplan Test Prep, and Coursera. ScholarPath may receive a commission when you click an affiliate link and complete a qualifying purchase. This commission comes at no additional cost to you.

All affiliate products and tools are independently selected by ScholarPath based on their relevance and potential value to our student audience. Affiliate relationships do not influence our scholarship award decisions, editorial content, or data presented in the School Directory.

ScholarPath is not responsible for the content, accuracy, products, services, or privacy practices of any third-party website reached through affiliate or other links on this Site. Links do not constitute endorsement of any third-party site or its operator.

4. School Directory and Data

The School Directory on this Site contains data sourced primarily from the U.S. Department of Education's College Scorecard and related federal databases. This data is provided for informational purposes only. ScholarPath makes reasonable efforts to keep data current and accurate but does not guarantee the accuracy, completeness, or timeliness of any school data presented.

Student testimonials and "Real Talk" submissions on school profile pages represent the personal opinions of the individuals who submitted them and do not reflect the views of ScholarPath. We do not independently verify the accuracy of testimonial content.

Do not rely solely on information from this Site when making decisions about enrollment, financial aid, or educational expenses. Always verify information directly with the school and with official sources such as the FAFSA and your school's financial aid office.

5. Intellectual Property

All content on the Site — including text, graphics, logos, icons, images, page layouts, and the compilation of all content — is the property of ScholarPath, Inc. or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the Site for personal, non-commercial purposes. You may not:

  • Reproduce, duplicate, copy, sell, or exploit any portion of the Site without express written permission from ScholarPath
  • Modify or create derivative works based on Site content
  • Use ScholarPath's name, logo, or trademarks in any manner that could cause confusion or that disparages ScholarPath

Student stories submitted through the Share Your Story form are licensed to ScholarPath on a non-exclusive, royalty-free basis. By submitting a story, you grant ScholarPath the right to publish, edit for length and clarity, and share your submission on the Site and in related promotional materials, subject to the consent you provide at the time of submission.

6. Disclaimer of Warranties

THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCHOLARPATH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ScholarPath does not warrant that the Site will be uninterrupted, error-free, free of viruses or other harmful components, or that defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any information on the Site.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCHOLARPATH, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to or use of (or inability to access or use) the Site
  • Any content obtained from the Site
  • Any scholarship application decision, including denial of an award
  • Any third-party products, services, or websites accessed through links on this Site
  • Any unauthorized access to or alteration of your transmissions or data

IN NO EVENT SHALL SCHOLARPATH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless ScholarPath, Inc. and its officers, directors, employees, volunteers, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Site.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices regarding the collection and use of your personal information.

10. Links to Third-Party Sites

The Site may contain links to websites operated by third parties. These links are provided for convenience only. ScholarPath has no control over the content or practices of any linked third-party site and accepts no responsibility for them. The inclusion of a link does not imply ScholarPath's endorsement of the linked site or its operator.

11. Modifications to the Site and Terms

ScholarPath reserves the right to modify, suspend, or discontinue the Site (or any portion of it) at any time without notice and without liability. We may also revise these Terms at any time by updating this page. The revised Terms will be effective as of the updated "Effective date" shown above. Your continued use of the Site after any revision constitutes your acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Monterey County, California, and you hereby consent to personal jurisdiction in those courts.

You agree that any cause of action arising out of or related to these Terms or the Site must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action is permanently barred.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ScholarPath with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written.
